LEGAL GUIDANCE

Serving legal documents in The Gambia: preparing instructions

Confirm the court’s requirements, recipient details and evidence of service before treating delivery as a completed procedural step.

Which proceedings do the documents belong to?

Identify the court, case number, parties and documents to be served. Explain whether proceedings are in The Gambia or abroad. Provide the issuing court’s order or directions and the relevant response or service date.

Service requirements depend on the proceedings and applicable rules. Posting, emailing or personally delivering documents should not be assumed to satisfy them without checking. A process-serving instruction needs a defined lawful method and a clear account of the required proof.

What information helps locate the correct recipient?

  • The full name and legal identity of the recipient.
  • Known addresses and how current each address is.
  • Whether the recipient is an individual, company or other organisation.
  • Available contact and identification information relevant to service.
  • Previous attempts, difficulties and any specific court directions.

Provide the information lawfully available to you and distinguish confirmed facts from leads. Do not assume that a company’s employee or a relative is necessarily authorised to receive documents.

What should overseas lawyers provide?

Send a clear written instruction identifying the originating jurisdiction’s requirements, document set, deadline and expected certificate, statement or affidavit. The receiving adviser should assess how those requirements interact with the Gambian process.

Translations, authentication or court permission may need investigation. A general assertion that service is valid worldwide is not a substitute for checking the particular case. Solie Law Chambers can discuss the Gambian work for an instructing professional client.

How should completion or failure be reported?

Agree the reporting format and what happens if the recipient cannot be found, refuses documents or the address is incorrect. Keep the evidence of the attempt and obtain advice on the next procedural step rather than treating an unsuccessful visit as completed service.

Allow time for the required proof to reach the instructing lawyer or court. Where a deadline is close, ask immediately whether the proposed instruction can be accepted.
