LEGAL GUIDANCE

Preparing for a court hearing in The Gambia

Clarify what the hearing is for, what has already been filed and what your lawyer needs before attending.

What does the notice or order require?

Keep the complete hearing notice, order or other court document. Record the court, case number, date and purpose of the hearing, together with any directions about documents, attendance or evidence.

Do not assume that every hearing will decide the whole case. Ask the lawyer to explain the issues likely to be considered and the preparation required. If you have just received papers, flag the dates before waiting to assemble a full account.

How should the case papers be organised?

  • The filed claims, responses and applications.
  • Previous orders, notices and relevant correspondence.
  • The contracts, records and other evidence relied on.
  • A chronology and a list of witnesses with their roles.
  • Any proposed settlement and relevant payment records.

Keep the original documents and identify missing material. Do not alter evidence or ask a witness to adopt an account that is not their own.

What should be agreed with the lawyer?

Confirm the accepted scope: initial advice, preparation, a particular hearing or the wider case. Establish who will attend, how you will be updated and which fees or expenses are included. Ask whether you need to attend personally and what arrangements should be made if you are abroad or require language assistance.

Discuss realistic objectives for the hearing and any instructions needed in advance. A lawyer should not be left to infer whether you can accept a proposal or incur additional work.

What happens after the hearing?

Obtain a clear account of the outcome, the order and the next dates. Record who must file, pay, serve or obtain documents. If the result may need to be challenged, raise that question promptly; the available route and time limits require case-specific advice.

Read civil litigation guidance, criminal appeal preparation or judgment enforcement according to the stage of your matter.
