LEGAL GUIDANCE

Gambian tax obligations: preparing for a legal review

Identify the transaction, taxpayer, period and disputed issue so that legal advice can be coordinated with accounting and filing work.

Which tax question needs an answer?

A tax review may concern a new business, rental income, a sale, payroll, an assessment or an outstanding debt. Start with the specific activity and the person or entity involved. Explain where the relevant parties live or are incorporated and which countries are connected to the income or asset.

Do not assume that using a foreign company, receiving money abroad or describing a payment as an investment removes Gambian tax questions. The facts, current law and any applicable relief need examination.

What records help the advisers?

  • Registration and tax identification records for the relevant person or business.
  • Returns, assessments, notices and correspondence for the periods concerned.
  • Contracts, invoices, payment records and supporting accounts.
  • A chronology of submissions, payments and communications.
  • Any advice or calculations already provided by an accountant.

Keep the original notices and record when they were received. If an objection, payment or response date is stated, flag it at the start rather than waiting until every supporting document is assembled.

How do legal and accounting work fit together?

An accountant may prepare records, returns or calculations; legal advice may address interpretation, transaction documents or a disputed assessment. Agree who is responsible for each task and who will communicate with the authority. This reduces the risk of inconsistent explanations or missed follow-up.

Ask for a written account of the issue, the information still needed and the options available. A proposed saving should be evaluated alongside compliance, reporting and the costs of implementing it.

What if another country is involved?

Provide details of overseas residence, ownership, work and income, together with existing foreign advice. Relief, credits and reporting obligations should be checked in both jurisdictions. A general online summary cannot establish the outcome for a particular taxpayer.

For a notice, investigation or disputed liability, use the tax problems and disputes service. For a new venture, incorporate tax questions into the launch plan before trading begins.

Official information

The Gambia Revenue Authority publishes official taxpayer information. Check the current rules and rates for the relevant period rather than relying on an old estimate.
