ECOWAS trade and investment: checks for a Gambian business

Test the proposed trading route, product requirements and eligibility for any claimed regional concession before building them into a contract.

What should a regional business plan identify?

Write down where goods originate, where they will be processed, the borders they will cross and who will sell to the final customer. Separate the countries of incorporation, transit and destination. These facts determine which customs, product and contractual questions need investigation.

A reference to ECOWAS in a proposal is not enough to establish the treatment of a particular shipment, business or individual. Obtain current confirmation for the actual route and activity, including any changes affecting the countries concerned.

Which assumptions need supporting evidence?

  • Any tariff preference, exemption or origin claim used in the price calculation.
  • Import or export restrictions and product-specific permissions.
  • The documents the supplier, carrier and importer must provide.
  • Who bears storage, delay and additional border charges.
  • Whether the proposed staff and representatives need immigration or work permission.

Ask the customs adviser to identify the evidence needed before dispatch. Do not assume that goods bought in a member state necessarily qualify for preferential treatment.

How can the contract accommodate the checks?

Make responsibility for licences, declarations, delivery records and payment conditions explicit. Set out how the parties will deal with a shipment held at a border, rejected documents or a change in requirements. Compare the sales agreement with transport and finance terms so that deadlines are workable.

For a new operation, complete the business launch checklist and identify which requirements arise in The Gambia and which require advice elsewhere.

What does a useful first instruction contain?

Provide the goods description, proposed route, parties, draft agreement and the concession or approval being relied on. Explain whether a purchase order is binding, money has been paid or goods are in transit. This lets the legal and customs advisers focus on the decision that cannot wait.

The firm’s trade and compliance work can be scoped around the Gambian aspects, with separate advice identified for other jurisdictions.
