LEGAL GUIDANCE

An accident in The Gambia: records to preserve for legal advice

After immediate safety and medical needs are addressed, keep an accurate record of the event, loss and communications.

What should happen first?

Seek appropriate medical assistance and contact the relevant emergency or public authorities where needed. Legal preparation should not delay care or necessary reporting. If you are visiting from abroad, contact your insurer or assistance provider through its verified details.

Once practical, record the date, time, place and people involved. Distinguish what you saw from what others told you. Do not put yourself at risk to gather photographs or other evidence.

Which documents may help a later review?

  • Medical records, treatment invoices and receipts.
  • Any police or incident report and reference number.
  • Photographs and witness details lawfully obtained.
  • Insurance details and relevant policy communications.
  • Evidence of lost earnings, repair costs or other claimed loss.

Keep the originals and record how each expense relates to the incident. A record of expenditure does not by itself establish another party’s legal responsibility for it.

What should be checked before accepting a payment?

Ask what a proposed payment or document is intended to settle. A receipt, discharge or release may have consequences beyond acknowledging money received. Obtain advice if you do not understand the wording, particularly where treatment or losses are still developing.

Record any deadline in an insurer’s letter or other notice and seek prompt advice on the applicable procedure and time limits. Avoid assuming that an ongoing conversation extends a deadline.

What can a legal review address?

The review can consider the available evidence, potential responsibility, claimed loss and options for pursuing or responding to a claim. The outcome depends on the facts, applicable law and practical recovery position; an accident does not automatically establish entitlement to compensation.

Explain if a tour operator, employer, insurer or party abroad is involved. Separate advice may be needed in another country. See civil litigation guidance for the wider process.
